State Board Accepts Settlement Agreements in Six Cases

At its meeting on October 21, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from George M. Armstrong, P.E., P.S., Elizabeth Stuber, P.E., James J. Porebski, P.E., Andrew Delzoppo, FS Tan Land Surveyors and Consulting Engineers, and Englobal U.S., Inc.

George M. Armstrong, P.E., P.S., a resident of Cincinnati, OH, affixed his seal and signature to engineering documents in a manner that was not in accordance with Ohio Administrative Code Section 4733, and failed to maintain business records as required.

Elizabeth Stuber, P.E., a resident of Louisville, KY, was found to have signed and sealed engineering documents for a firm that did not possess a Certificate of Authorization to offer or provide engineering services in Ohio.

James J. Porebski, P.E., a resident of Pompano Beach, FL, failed to cooperate with the Board in its investigation of a complaint by failing to respond to multiple requests for information related to the denial of his application for license by the Delaware Association of Professional Engineers, the organization that governs the practice of engineering in the State of Delaware.

Andrew J. Delzoppo, Architect, a resident of Pickerington, OH, was found to have offered and provided engineering services in Ohio.

FS Tan Land Surveyors and Consulting Engineers, located in Louisville, KY, provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization from this Board.

Englobal U.S., Inc., located in Broomfield, CO, failed to report a prior disciplinary action taken against the firm by another state board on its Certificate of Authorization application as required.

State Board Issues Final Order Revoking PE License

At its meeting on October 21, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors issued a Final Order to revoke the professional registrations of James W. Ballinger.

James W. Ballinger, a resident of Lebanon, OH, was found guilty of violating Ohio Revised Code Section 4733.20 (A) (5) and Ohio Administrative Code Section 4733-35-09, as a result of Mr. Ballinger failing to cooperate with the Board in its investigation of a complaint, and failing to provide information and documents as required by the Board upon its request.

State Board Accepts Settlement Agreements in Two Cases

At its meeting on August 19, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Kevin D. Schafer, P.E., P.S. and Matthew B. Phelps, P.E.

Kevin D. Schafer, P.E., P.S., a resident of Charlestown, WV, submitted an application to become registered as a professional engineer in Ohio based on his registration in West Virginia. On the application Schafer failed to report a disciplinary action taken by the West Virginia Board of Professional Surveyors in 2007 for minimum standard violations.

Matthew Phelps, P.E., a resident of Galveston, TX, submitted an application to become registered as a professional engineer in Ohio based on his registration in Texas. On the application Phelps failed to report a disciplinary action taken by the Texas Board of Professional Engineers in 2005 for unprofessional conduct.

Jerald Hasbrouck, Dale Haywood, Richard Hiatt, Kemron Environmental Services Inc, Jason Seaverson, Peter Theodorakakos | State Board Accepts Settlement Agreements in Three Cases and Issues Three Final Orders 

At its meeting on July 15, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted three settlement agreements from the following individuals and company:

Jason M. Seaverson, P.E., a resident of Fuquay Varina, NC, received disciplinary action in South Carolina and failed to report it to the Ohio Board as required by Ohio Administrative Code (O.A.C.) 4733-35-07.

Kemron Environmental Services, Inc., of Marietta, OH, offered and provided engineering services in Ohio at a time the firm did not possess a Certificate of Authorization with this Board.

Dale Haywood, P.E., a resident of Elyria, OH, failed to report that he surrendered his Florida professional surveyor’s license within the allowed time as required by Ohio Administrative Code 4733-35-07.

At the meeting the Board also issued three final orders revoking the professional engineer registration of the following individuals:

Peter K. Theodorakakos, P.E., a resident of Gainesville, TX, pled guilty in the Southern Division of the Eastern District of Michigan United States District Court to one count of Conspiracy to Commit Bank Fraud.

Richard L. Hiatt, P.E., a resident of Cincinnati, OH, failed to report the revocation of his professional engineer registration by the Kentucky Board of Licensure for Professional Engineers and Land Surveyors as required by Ohio Administrative Code 4733-35-07.

Jerald Hasbrouck, P.E., a resident of Columbus, OH, was found to have affixed his professional engineer seal to engineering plans that were not prepared under his direct supervision on numerous occasions.

Joshua Carney, Kowalski Engineering Inc | State Board Accepts Settlement Agreements in Two Cases 

At its meeting on May 27, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Joshua M. Carney and Kowalski Engineering, Inc.

Joshua M. Carney, P.E., a resident of York, PA, submitted an application for registration in Ohio in which he failed to report a previous disciplinary action taken by the Pennsylvania State Board of Professional Engineers for providing engineering services with an expired license.  

Kowalski Engineering Inc. of Cincinnati, OH, offered and provided engineering services in Ohio at a time the firm did not possess a Certificate of Authorization with this Board.

Larry Ayer, Matthew Ayer, Edward Klein, Stephen Maslan, Randolph Piersall, Stephanie Sires | State Board Accepts Settlement Agreements in Six Cases 

At its meeting on April 29, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Randolph Piersall, P.E., Stephanie Sires, P.S., Stephan Maslan, P.E., Edward Klein, Larry Ayer, P.E. and Mathew Ayer, P.E.

Randolph S. Piersall, P.E., a resident of Westerville, OH, submitted structural engineering plans for the design of a university theater that contained serious errors and deficiencies.

Stephanie A. Sires, P.S., a resident of Norton, OH, performed a mortgage location survey for a residence located in Youngstown, Ohio that did not meet the Standards for Mortgage Location Surveys (Ohio Administrative Code 4733-38).

Stephen P. Maslan, P.E., a resident of Kansas City, MO, entered into a settlement agreement based on disciplinary action taken against him by the Missouri Board for Architects, Professional Engineers, Professional Land Surveyors, and Landscape Architects and the Kansas State Board of Technical Professions for illegally practicing architecture and signing and sealing fire protection documents that were determined to be deficient and contained numerous life safety issues. 

Edward Klein, P.E., a resident of Youngstown, OH, provided engineering services in Ohio at a time his professional engineer registration was expired.  

Larry Ayer, P.E., President of e2m Engineering Inc., and resident of Cincinnati, OH, provided engineering services in Ohio at a time e2m Engineering Inc. did not have a Certificate of Authorization with this Board.  

Matthew Ayer, P.E., of Ayer Quality Engineering, and resident of Cincinnati, OH, provided engineering services in Ohio at a time Ayer Quality Engineering, did not have a Certificate of Authorization with this Board.

Humphrey Design and Drafting LLC, Art Hunkele, Roy Light, Loren Purdom | Board Accepts Settlement Agreements in 4 Cases 

At its meeting on February 18, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Loren R. Purdom, P.S.; Humphrey Design & Drafting, LLC; Roy W. Light, P.S.; and Art J. Hunkele, P.E.

Loren R. Purdom, P.S., a resident of Wheelersburg, OH, failed to disclose a suspension of his Kentucky professional surveyor registration by the Kentucky State Board of Registration for Professional Engineers and Surveyors to the Ohio Board as required by Ohio Administrative Code 4733-35-07.

Humphrey Design and Drafting, LLC of Pataskala, OH, offered and provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

Roy M. Light, P.S., a resident of Coshocton, Ohio, entered a plea of guilty to making False Material Statements under the Clean Water ACT, 33 USC 1319(c)(4), a class B felony.

Art J. Hunkele, P.E., a resident of Cincinnati, OH, affixed his seal and signature to documents certifying to the accuracy and completeness of the information contained in the sealed documents that was later determined to be incorrect.

At its meeting on January 21, 2014 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Aquatic Design & Engineering; Foster Energy Management Co.; GPW & Associates, LLC; Siemens Industry, Inc.; Roger W. Woodfill, P.S.; Eric Exley, P.E.; FXB Engineering; James R. Hogan and David M. Allison, P.E.

Aquatic Design & Engineering of Orlando, FL, offered engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

Foster Energy Management Co. of Columbus, OH, offered engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

GPW & Associates, LLC of Lawrence, KS, offered and provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

Siemens Industry, Inc. of Buffalo Grove, IL, offered and provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

Roger W. Woodfill, a resident of Lawrenceburg, IN, failed to disclose disciplinary action taken against his professional surveyor registration by the Indiana State Board of Registration for Professional Surveyors.

Eric Exley, P.E., a resident of Steubenville, OH, failed to disclose disciplinary action taken against his Pennsylvania professional engineer’s registration that resulted in a suspension.

FXB Engineering, Inc. of Glen Mills, PA, offered and provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board. 

James R. Hogan a resident of Mokena, IL, offered and provided engineering services in Ohio and affixed a fraudulent seal to engineering work product for an Ohio project.

David M. Allison, P.E. a resident of Xenia, OH, provided engineering services in Ohio by affixing his seal and signature to engineering work product at a time when Mr. Allison did not possess an active registration with this Board.
