At its meeting on November 15, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Mark W. Hoffman, Edward L. Sutliff, Robert C. Gauss, Karl L. Dammeyer and Carl V. DeCais.

Mark W. Hoffman, P.E., a resident of Rome Township, Ohio, aided and abetted the unlicensed practice of engineering by an unlicensed drafting company.

Edward L. Sutliff, a resident of Rome, Ohio and owner of Western Reserve Drafting, offered and provided engineering services in the State of Ohio at a time when he did not possess a certificate of authorization.

Robert C. Gauss, P.E., a resident of Aurora, Ohio, was randomly selected for the Board’s continuing professional development audit. Gauss contacted the Board and reported that even though he indicated on his renewal form that he met the continuing education requirement, he did not complete the requirement prior to renewing his registration for 2011. Gauss offered to enter into a settlement agreement wherein he voluntarily surrendered his professional engineer registration for violating the Ohio Revised Code.

Karl L. Dammeyer, P.E., a resident of St. Mary’s Ohio, was randomly selected for the Board’s continuing professional development audit. Dammeyer contacted the Board and reported that even though he indicated on his renewal form that he met the continuing education requirement, he did not complete the requirement prior to renewing his registration for 2011.

Carl V. DeiCas, P.E., a resident of Monessan, PA, had his professional engineering license suspended by the West Virginia State Board of Registration for Professional Engineers for one year for allowing another person to use his suspended license on at least 8 projects.

Nelson E. Kohman, P.E. was appointed to the Board by Governor Kasich for a term beginning October 5, 2011 and ending September 24, 2016. Mr. Kohman is the retired President of Evans, Mechwart, Hambelton & Tilton (EMH&T, Inc.). As President of EMH&T Mr. Kohman led the firm to become the largest full-service engineering firm in Central Ohio with over 400 employees. Mr. Kohman has over 30 years of engineering experience, where he was involved in developing client relationships with communities and government agencies, preparing economic and environmental impact studies and serving as a consulting engineer and advisor to growing communities and numerous planning and zoning commissions.

At its meeting on September 15, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from William B. Ingram, P.S., American Land Surveyors, Inc. and Terry N. Kohler, P.S. and Vance Surveying Ltd. and Samuel R. Vance, P.S.

William B. Ingram, P.S. of Amanda, Ohio violated Ohio Revised Code Section 4733.16 by listing himself as  the full-time manager in responsible charge of surveying activities and decisions for Planning Design Associates at a time that he was not a full-time employee of the firm and was not responsible for the firm’s surveying operations.

American Land Surveys, Inc. and Terry N. Kohler, P.S. of Batavia, Ohio provided surveying services in Ohio at a time when the firm’s Certificate of Authorization was expired.

Vance Surveying Ltd. and Samuel R. Vance, P.S. of Mount Vernon, Ohio provided surveying services in Ohio at a time when the firm did not have a Certificate of Authorization to provide such services.

At its meeting on July 20, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted a settlement agreement from Charles R. Miller, P.S.

At its meeting on June 15, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Ronald Booth, P.E., Roy L. Brown, P.E., John Germ, Gary Elliott, P.S., David R. Mills, P.S., David Morgan, P.E.,  Red Plains Surveying Company, Edward Rohr, P.E., Richard A. Schlarman, Sara Sowers, P.E.

Ronald Booth, a resident of Auburn, Alabama, failed to provide his continuing education documentation for 2008, 2009 and 2010 during the Board’s annual audit in accordance with R.C. 4733.151.

Roy Lee Brown, P.E., a resident of Birmingham, Alabama, voluntarily surrendered his professional engineer registration in Kentucky in order to avoid disciplinary action by the Kentucky Board involving allegations that Brown affixed his seal and signature to engineering drawings that were prepared by an unlicensed firm and contained errors and omissions of the acceptable standards of engineering practice.

John F. Germ, P.E., a resident of Chattanooga, Tennessee, voluntarily surrendered his professional engineer registration in Oklahoma in order to avoid disciplinary action by the Oklahoma Board involving an allegation of aiding and assisting an unlicensed firm in offering or providing engineering services without a certificate of authorization.

Gary Elliott, P.E., a resident of Hannibal, Missouri, was found to have aided and abetted the unlicensed practice of surveying in Ohio by affixing his seal and signature to surveying work product prepared by Red Plains Surveying Company an Oklahoma City, Oklahoma based company that did not have a certificate of authorization to offer or provide surveying services in Ohio.

David R. Mills, P.S., a resident of Gambier, Ohio, entered into a settlement agreement in order to avoid further disciplinary action based on a complaint that Mills performed a mortgage survey and boundary survey that did not comply with the Standards for Boundary Surveys (O.A.C. 4733-37) and the Standards for Mortgage Location Surveys (O.A.C. 4733-38).

David B. Morgan, P.E., a resident of North Canton, Ohio, was randomly selected for the Board’s continuing professional development audit. Morgan contacted the Board and reported that even though he indicated on his renewal form that he met the continuing education requirement, he did not complete the requirement prior to renewing his registration for 2011.

Red Plains Surveying Company, based out of Oklahoma City, Oklahoma, entered into a settlement agreement wherein the firm agreed to pay a $2,500 fine and discontinue offering or providing surveying in Ohio until the firm is granted a certificate of authorization.

Edward C. Rohr, P.E., a resident of Toledo, Ohio, failed to provide his continuing education documentation for 2008, 2009 and 2010 during the Board’s annual audit in accordance with O.R.C. 4733.151.

Richard A. Schlarman, a resident of Columbus, Ohio, was observed by Board staff looking at another examinee’s answer sheet on multiple occasions during the Fundamentals of Engineering examination at the Columbus testing site. After the exam Schlarman was interviewed by the Board’s investigator and admitted to cheating on the exam.

Sara L. Sowers, P.E., a resident of Kettering, Ohio, was randomly selected for the Board’s continuing professional development audit. Sowers contacted the Board and reported that even though she indicated on her renewal form that she met the continuing education requirement, she did not complete the requirement prior to renewing her registration for 2011.

William R. Yoakam, P.E., P.S., a resident of Springboro, Ohio, was charged with violations of Ohio Revised Code Sections 4733.20 (A)(1) and (5) and Ohio Administrative Code Sections 4733-19-01 and 4733-35-08 based on the revocation of his professional engineer license in Kentucky and failing to report the revocation to the Ohio Board within 30 days.

At its meeting on April 13, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors voted to revoke the professional engineer registrations of Edward DeTullio and James Edward Welp.

Edward DeTullio, a resident of Berea, Ohio, was charged with violations of Ohio Revised Code Sections 4733.151 (A) and (G), 4733.20 (A) (1) and (5), 4733.22 and Ohio Administrative Code Section 4733-35-09 for failing to complete 15 hours of continuing education and falsely reporting on his annual renewal that he had completed the annual continuing education requirement.

James Edward Welp, a resident of West Chester, Ohio, was charged with violations of Ohio Revised Code Sections 4733.151 (A) and (G), 4733.20 (A) (1) and (5), 4733.22 and Ohio Administrative Code Section 4733-35-09 for failing to complete 15 hours of continuing education and falsely reporting on his annual renewal that he had completed the annual continuing education requirement.

At its meeting on April 13, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Letitia Acox Zurawick, Bryan J. Smith and Lawrence Fischer.

Letitia Acox Zurawick, a resident of Holland, Ohio, failed to provide her continuing education documentation for 2008, 2009 and 2010 during the Board’s annual audit in accordance with R.C. 4733.151.

Bryan J. Smith, a resident of Carroll, Ohio, entered into a settlement agreement due to his failure to complete the continuing professional development requirement for 2011.

Lawrence Fischer, a resident of Orlando, Florida, entered into a settlement agreement with the Board to voluntarily relinquish his professional engineer registration.

At its meeting on February 16, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Technical Solutions Specialists Inc. and George Mihal; Horizon Surveying, Inc. and Paul MacCallum; Power Solutions Group and Barry W. Willoughby; Michael J. Dorsey; Ronald Grolle and Black Swamp Consulting, LLC; and Stephen M. Bowman.

Technical Solutions Specialists, Inc. and George Mihal of Cincinnati, Ohio provided engineering services in Ohio at a time when the firm’s Certificate of Authorization was expired. Horizon Surveying, Inc. and Paul MacCallum of Lebanon, Ohio provided surveying services in Ohio at a time when the firm’s Certificate of Authorization was expired. Power Solutions Group and Barry W. Willoughby of Sidney, Ohio provided engineering services in Ohio at a time when the firm’s Certificate of Authorization was expired.

Michael J. Dorsey, a resident of Uniontown, Ohio, failed to respond to two separate requests to submit his continuing education documentation for 2008 and 2009 during the Board’s annual audit.

Stephen M. Bowman, a resident  of Zanesville, Ohio, provided surveying services in Ohio at a time when his professional surveyor registration was expired.

Ronald F. Grolle and Black Swamp Consulting, LLC of Bowling Green, Ohio provided surveying services in Ohio at a time when Grolle did not possess registration as a professional surveyor and the firm, Black Swamp Consulting, LLC, did not have a Certificate of Authorization to offer or provide surveying services in Ohio.

At its meeting on February 16, 2011 the Ohio State Board of Registration for Professional Engineers and Surveyors suspended the Professional Engineer registration of Kerry L. Pickett, P.E. of Kings Mills, Ohio for two (2) years, with that suspension stayed pending compliance with conditions ordered by the Board.
